Determine the digital course yourself
Non-European players dominate the IT sector – with consequences for prices, data access and negotiating power. At the same time, regulations such as NIS-2, the GDPR and the EU Data Act require organizations to document where data is stored and who has access to it. This is a significant gap between theory and reality: “EU region” in a contract does not automatically mean data is stored within the EU and a data center in Germany offers no protection if the operator is affected by the U.S. CLOUD Act. Many offerings are also “black boxes”. They lack transparency in their operations, have unclear lines of responsibility and are expensive in Lock-in. Such IT solutions only offer stability to the extent of their availability, pricing policies and legal status.

Digital sovereignty means knowing at all times where your data is stored, who operates the systems, and which laws apply to it.
Sovereignty can be assessed by asking four questions that every provider should be able to answer with verifiable evidence:
• Location: Where is the data physically located—and is this contractually guaranteed, or is it merely a regional indication?
• Operation: Who actually operates the platform, and who has administrative access to it?
• Legal Jurisdiction: Which legal system governs the operator—not just the data center?
• Ability to Exit: How difficult would it be to switch providers, and in what format would I receive my data back?
The first step toward implementing digital sovereignty is to take stock: Which systems are business-critical, where is their data located, who operates them, and how difficult would it be to switch providers? Only then can you decide where action is needed and where an existing dependency is justifiable. To this end, DTS provides a “Sovereignty Checkup” as a self-assessment tool that allows companies to systematically evaluate their current status.
No. A location in Europe alone does not guarantee complete digital sovereignty. In addition, companies should verify who operates the data center, which legal system applies, and who can gain access to data and systems.
Several current regulations require companies to provide evidence of where data is stored and who has access to it:
• GDPR – Lawfulness of processing and transfers to third countries
• NIS-2 – Evidence of security measures and the supply chain
• EU Data Act – Data access, portability, and the ability to switch cloud services
The following applies to all three: The burden of proof lies with the company, not with the provider. Sovereignty is therefore also a matter of a company’s own ability to document compliance.
